The law compels women to wait 72 hours between their initial visit and the procedure, view an active ultrasound and sign a form pledging that they’ve read a booklet that includes the line, “[t]he life of each human being begins at conception. Abortion will terminate the life of a separate, unique, living human being.”

She declined to hear her fetus’ heartbeat and felt “guilt and shame,” according to court documents.

She claims that “the sole purpose of the law is to indoctrinate pregnant women into the belief held by some, but not all, Christians that a separate and unique human being begins at conception,” according to the court’s opinion. “Because the law does not recognize or include other beliefs, she contends that it establishes an official religion and makes clear that the state disapproves of her beliefs.”

A couple whose engagement photo was plastered across the cover of an erotica book featuring New England Patriots tight end Rob Gronkowski without their permission can’t sue the companies that distributed the bawdy novel, a federal appeals court has ruled.

The Ohio couple — dubbed John and Jane Roe in court documents — said their engagement photo was ripped from the web without their permission and put on the front cover of “A Gronking to Remember,” a 67-page fictional jaunt chronicling the exploits of a married woman who becomes obsessed with the Pats star and “the unrivaled power of his touchdown dance.”

This week’s 6th U.S. Circuit Court of Appeals ruling upheld a lower court’s dismissal of the case against Amazon.com, Barnes & Noble and Smashwords — the companies that distributed the self-published book.

The court found that the companies had no role in creating the book and therefore couldn’t be held liable. I find that interesting given how self-publishing now works online; however, I "get" the protections of publishers to prevent them being stifled by fears of lawsuits.

“We are happy with the judgment and feel it is fair and just,” said Mark Coker, CEO of California-based Smashwords. “We were disappointed this even made it to court. We viewed it as a threat to free expression and a threat to publishing. It would have been horrible if book distributors could be held liable for the content of their books.”

The cover, which has since been changed, included a photo of the couple and was widely displayed in the days leading up to the 2015 Super Bowl, according to court documents.

“The subject matter of the book, A Gronking to Remember, is less than tasteful and is offensive. The use of the Plaintiffs’ image has held them up to ridicule and embarrassment,” wrote David E. Beitzel, an attorney for the couple. “This outrageous connection has been further aggravated when the book, with the Plaintiff’s image, has been reproduced in the media nationwide.”
Greg McKenna wrote the book under the pen name Lacey Noonan, according to court documents. Other claims against McKenna are still pending, according to the appeals court’s ruling. Attorneys listed for McKenna did not respond to multiple requests for comment.

In a court document filed in 2015, McKenna admitted that, for the cover, “I used images that I downloaded from the Internet including a photograph of Rob Gronkowski and a photograph of a man and a woman embracing.”
