Trump indicated where he stands on medical marijuana for the first time since he took office

President Donald Trump issued his first statement on medical marijuana since he took office.

Trump, who has stayed mum on the topic of marijuana since the election, finally gave an indication as to where he stands on the issue in his statement after he signed the bill:
"Division B, section 537 provides that the Department of Justice may not use any funds to prevent implementation of medical marijuana laws by various States and territories. I will treat this provision consistently with my constitutional responsibility to take care that the laws be faithfully executed."
Tom Angell, the founder of Marijuana Majority, an advocacy group, told Business Insider he thinks that Trump's statement is the federal government's way of "asserting their right" to go after certain medical marijuana businesses if they choose to at a later date.

"[M]y read is it's basically saying they reserve the right to do whatever they want and enforce prohibition regardless of the statutory prohibition on doing so," Angell said, though he doesn't think it necessarily indicates a federal crackdown on medical marijuana is coming.

Jeff Sessions, the attorney general, told Colorado Gov. John Hickenlooper during a private meeting in April that prosecuting state-legal marijuana businesses wouldn't be a priority for the Justice Department.

One has to be aggressively obtuse to think these data support continuing this program. And yet Sessions restarted the private prison program in late February and released a memo yesterday directing prosecutors to charge the “most serious and readily provable offense.” This is a complete rollback from the Obama era which sought to decrease the severity of charges for low-level drug crimes.

Our incarceration rate is already the highest in the world by a significant margin, and that includes outright autocratic regimes.

Marijuana News Roundup: California Assembly Votes to Become a ‘Sanctuary State’
Last Thursday, the California state Assembly approved a bill that would prohibit state and local law enforcement officers from assisting federal drug agents making arrests of people complying with the state’s drug laws. The bill now moves to the state Senate.

The bill, if passed by the Senate and signed by the governor, would effectively make California a “sanctuary state” against enforcement of federal drug laws related to the sale and use of marijuana. The state is also considering similar legislation to become a sanctuary state regarding federal immigration laws.

Well I guess Sleeve was right about Sessions after all:

Jeff Sessions personally asked Congress to let him prosecute medical marijuana providers
Attorney General Jeff Sessions is asking congressional leaders to undo federal medical marijuana protections that have been in place since 2014, according to a May letter that became public Monday.

The protections, known as the Rohrabacher-Farr amendment, prohibit the Justice Department from using federal funds to prevent certain states "from implementing their own State laws that authorize the use, distribution, possession or cultivation of medical marijuana."

In his letter, first obtained by Tom Angell of Massroots.com and verified independently by The Washington Post, Sessions argued that the amendment would "inhibit [the Justice Department's] authority to enforce the Controlled Substances Act." He continues:
I believe it would be unwise for Congress to restrict the discretion of the Department to fund particular prosecutions, particularly in the midst of an historic drug epidemic and potentially long-term uptick in violent crime. The Department must be in a position to use all laws available to combat the transnational drug organizations and dangerous drug traffickers who threaten American lives.
Sessions's citing of a "historic drug epidemic" to justify a crackdown on medical marijuana is at odds with what researchers know about current drug use and abuse in the United States. The epidemic Sessions refers to involves deadly opiate drugs, not marijuana. A growing body of research (acknowledged by the National Institute on Drug Abuse) has shown that opiate deaths and overdoses actually decrease in states with medical marijuana laws on the books.

We have an interesting Clusterfuck going on with pot in Nevada.

So, when our referendum passed, it was based on the premise of 'regulating cannabis like alcohol'. For some stupid reason this also included giving alcohol wholesalers first crack at the rights to distribute it to the retailers. With the proviso that if an insufficient number of wholesalers were interested, then the state could give the rights to the companies that already exist distributing medical marijuana.

Now, our legislature just finished up its session, and among the things it did was set up all the regulatory frameworks for the cannabis industry. The referendum gave them until January of 2018 to get that done, but their intent was to get shops rolling by July. I guess our state budget has cannabis revenues factored in already and everything, so they fast tracked it. And to this end, they decided that the wholesale liquor dealers had not shown sufficient interest and decided to give the medical distributors a shot at it.

Only now, the alcohol wholesalers are crying foul, and are holding the whole deal up in court. Who knows when or if the issue will get resolved.

Yay.

Sounds like they built a sort of corruption into the system. Why these people should get preference over others I don't know (other than they are probably generous donors to the right politicians).

Yeah, I have no idea why they did it that way. Basically, they have companies fighting over a monopoly. I also know that even with this clusterfuck, a grand total of 5 applications for distributor licenses (out of 91) came from liquor distributors. So I don't even know why they are bitching about having competition in a field they seemed to have no interest in anyway. It's stupid.

On the other hand, if they get this clusterfuck straightened out. Reno already has 4 dispensaries medical dispensaries that have applied to become recreational dispensaries as well on July 1. No dispensaries in Carson (where I actually live), but that is no surprise as the sherrif and mayor were both huge in the campaign to vote down recreational pot. So I am 100% certain they will make it as difficult as posible for any to open here.

On the other hand, another stupid rule they put into place is that you can't grow your own if you live within 25 miles of a dispensary and Reno is 30 miles away, so I bet there will be a lot of home growers in this town.

Jesse Ventura Is Fighting Again--This Time, It's To Legalize Marijuana
Jesse “The Body” Ventura has been a long time supporter of marijuana legalization, but it took a seizure and medical marijuana to turn him into an advocate. Ventura didn't personally experience the seizures. It was someone close to him that suffered from seizures two to three times a week. A helpless feeling as he watched that person suffer and all he could do was hold them and wait for the seizure to run its course.

“Four different pharmaceuticals weren't working. The seizures were continuing,” he said. So he and his friend got in the car and drove to Colorado. “We had no choice.” Feeling fortunate that he had the means to go and friends in the state, he was able to get some cannabis for his friend (illegally, since they weren't residents) and it worked. “This person hasn't had a seizure since,” said Ventura.

The biggest drawback now is price. It's $30 a month in Colorado, but $600 in Minnesota and insurance doesn't cover it. “Insurance should be paying for it because it works,” he added.

This experience was powerful and moving. It caused Ventura to dig deeper into the properties of medical marijuana and motivated him to write a new book, The Marijuana Manifesto, with Jen Hobbs. He spent months on research and is now speaking more forcefully for legalization.

Just a follow up: Here's when you can start legally buying marijuana in Nevada
Sales of recreational marijuana kick off in Nevada on Saturday, July 1, and the state is expecting on onslaught of tourists coming to sample the local merchandise.

But visitors might have tough times finding the drug in stores.

Anyone who is 21 and over with a valid ID can buy up to an ounce of pot (or one-eighth of an ounce of edibles or concentrates) from one of several medical marijuana dispensaries that have been approved for recreational sales.

State regulators have issued the licenses necessary to 17 retail outlets in Las Vegas — as of June 27 — and may approve as many as 40 dispensaries by Saturday, the Associated Press reported.

In a legal snafu, those stores may sell the marijuana they have in stock for recreational use, but may not resupply their inventory and sell the new stuff to non-medical users. Their stock may run out as early as August, leaving recreational users without a place to buy their legal bud.

Alcohol wholesalers have the exclusive rights to move recreational marijuana from growers to retailers in Nevada, as part of a temporary court order that was extended by a Carson City district judge in June. Nevada intends to appeal the order, so that the state's medical marijuana dispensaries can obtain pot distribution licenses, according to the Associated Press.
