NORRISTOWN, Pa. (CBS/AP) — The jury in the Bill Cosby sex assault trial is having trouble reaching a verdict.

As deliberations continued into the fourth day, the tired and anxious jury told Judge Steven O’Neill that they are deadlocked.

“We cannot come to unanimous consensus on any of the counts,” the jury said.

However, the judge has told them to keep working.

Cosby spokesman Andrew Wyatt says this is somewhat a victory for the actor and comedian.

Here is my prediction. Hung jury (THAT'S a no brainer since they cannot agree on any count thus far). Cosby reaches a plea deal for house arrest x36 months. Cosby then has hot wannabe's come directly to his home so he can continue to drug and rape them.

On Friday morning, jurors came back with more questions. They wanted to know what is “reasonable doubt.” They also asked to rehear Cosby’s 2005 deposition.

Mistrial is going to happen
NORRISTOWN, Pa. — The judge in Bill Cosby's sexual assault trial here rejected another defense motion for a mistrial over a struggling jury, instead sending the jurors back again to continue deliberating for a fifth day on Friday.

Judge Steven O'Neill has now rejected two motions for a mistrial within the first three hours Friday morning. The jury has been deliberating more than 43 hours since they got the case Monday evening.

O’Neill told lead defense attorney Brian McMonagle that he has no authority to interrupt a jury that is actively deliberating, no matter how long they go on. So far Friday, there is no indication that the jurors are not progressing with their deliberations, O’Neill said.

“I have no ability to do anything other than what I have done in this case,” O’Neill said. The jury “has been working extraordinarily hard for the past 26 hours” since they announced they were deadlocked on all three counts on Thursday and the judge told them to try again.

O’Neill said McMonagle should provide legal precedents to show when a judge interrupted and ended ongoing deliberations. "You’ve given me no cases...that a judge has a right to stop a jury from deliberating when they are actively deliberating,” O'Neill said.

McMonagle countered that jurors may believe they are obligated to continue hashing out a unresolvable dispute, following O’Neill’s statement from yesterday directing the body to continue after they announced a deadlock.

O’Neill did say he “intends to act” if jurors indicate again they are hopelessly deadlocked.
They cannot agree on a single charge. I will not buy pudding. But it is admittedly a small sacrifice. I know he did it but not necessarily with her. My prediction will hold.

Or does there even have to be another trial after a mistrial?

There doesn't have to be a retrial. The DA has four months to bring the case again. He 'tweeted' immediately after the mistrial that he will. What will more likely happen is that he'll offer Cosby a plea deal Cosby can live with. I'm betting 3 years house arrest.

Much speculation over by Free Republic that the jury was divided along racial lines.

No way to know of course, but I'm guessing that's not it.

Given just the evidence presented, I would have a hard time saying guilty beyond reasonable doubt. Given the evidence not presented, it would have been easy. I'll give 50/50 odds it was racially divided.

I really like Bill. He's hard to convict.
