They can claim they are doing that but as they are overturned, their justification did not prove legal.

The Hawai'i judge tried to argue that this was "discriminatory," hence "violates the Amendments!" Appeals told him to stuff it. It, and others, are before SCOTUS, and the fact they issued an injunction in favor the the Administration, does not portent too well for those who share the view of the Hawai'ian [Stop that.--Ed.] judge.

But then, SCOTUS can do what they will: "we're not final because we're infallible, we're infallible because we're final."

It does, however, meet my point, that it wasn't a dispute over presidential vs congressional authority.

As an aside but related I get the impression that SCOTUS is getting more and more annoyed at Congress' taking a passive role in governance.

Interesting. That was an argument Scalia would make in lectures and discussions that if you wanted to change some things, make a good law and/or amend the Constitution rather than expect the Federal Judiciary to do the job for you. That would cut in ways I suspect Scalia would not agree with: such as the Conservative Republican attempts to change abortion laws by hoping the numbers in the SCOTUS change. Scalia might have been behind overturning Roe v. Wade.

However, it seems some of the larger fuck-ups SCOTUS has recently had to fix came from Congress--and Clinton/Obama [Bush--Ed.]--over-reaching in ways they should have bloody know better about: such as DOMA. So embarrassing, Clinton and Obama try to pretend they did not support it. McCain Feingold.

I never contradicted that. Or, perhaps I should say I never intended to. I merely wished to distinguish the Hawaii decision from a separation of powers dispute, since that was brought up as an example of a court assigning improper separation of powers.

Maybe it is a consequence of a Congress more interested in symbolic opposition than actual governance. And that does go both ways, though sometimes in different behaviors.

I have no problem making sure that everyone who votes is eligible to vote.

I have a huge problem with putting in a mechanism to make sure of that, then making it as difficult as possible for people of the other party to do so.
