When the majority caved on Eric Holder I long ago concluded they were all lip and no teeth.

Because he previously refused to answer questions publicly claiming classified information.

If Trump won't sit for an interview with Mueller, why should Comey submit to this?
Perhaps he could offer to have his lawyer provide written answers to their questions, as Trump's lawyers do for Mueller.

1. Trump cannot be subpoenaed by congress because of executive privilege.
2. If Trump could be subpoenaed, he could take the 5th.
3. Comey can be subpoenaed but can also take the 5th.
4. Congress can grant immunity to Comey forcing him to answer (re: oliver north).
5. What fun would that be?

I think your no. 1 assertion there is questionable. Clinton was compelled to testify in the Paula Jones lawsuit iirc. Of course, it would probably go to the Supreme Court if they tried to force the issue.

Apples and Gram's Mom.

But I suspect you know this.
Mueller is not actually a congressional committee nor even a "small village with a majestic view of the Nene Valley."

Though I suppose he could always plead the Fifth. . . .

That was not congress. It was a civil proceeding, not a criminal one. And he could have refused to answer, regardless. But he did answer and decided to lie.

Can we non-elites refuse to appear when subpoenaed?

The trick is: don't answer your door. When in public, use dark sunglasses, a fake mustache, and a wig. That keeps you from getting served. Maybe a fat body suit also. Or in your case a skinny one.

North Korea or Libya would work too, but Iran has decent restaurants and flush toilets.

I have a hard time thinking Comey was in the tank for either candidate, considering how likely it is that he delivered the killing blow to Clinton's run.

He might still have fucked up. Just not for that reason.
"If fighting is sure to result in victory, then you must fight! Sun Tzu said that, and I'd say he knows a little bit more about fighting than you do, pal, because he invented it, and then he perfected it so that no living man could best him in the ring of honor. Then, he used his fight money to buy two of every animal on earth, and then he herded them onto a boat, and then he beat the crap out of every single one. And from that day forward any time a bunch of animals are together in one place it's called a zoo! (Beat) Unless it's a farm!"

I think received wisdom, was that Clinton would still win and that she (and comey ) would be untainted afterwards as everything would have been aired before the vote.

Of course, that was before Hubris shanked Clinton, leaving us to be subjected to Bathos.

He was despised by both sides for the very behavior he consistently exudes: pompous self-righteousness and self-importance.

I was willing to grant that he did not want to "determine" the election, and in doing that, he fucked it up twice. True or not, he appeared to be in the tank. He should never have made a determination whether or not Her Turn should be indicted; that was never his job. He should have passed it to his Obama superior who would have refused to indict her. That would have left his hands clean.

But he knows more than everyone else and thought he had an answer that blew up in his face.

Back when it still looked to be Her Turn and the Republicans were deciding how best to make her life Hell, it was assumed she would shit-can him over the "strenuous objections" of the Republicans who hated him also.

His subsequent behavior remains indefensible, but since he a cop and everyone else is "little people" he figures he will get away with it. Mueller protected dirty FBI agents in Boston; he is not going to go after Comey.

The Big Question behind all of this is "so what" with regard to levels of "give a shit." It appears that Kelly may have lied about lying simply because he could not afford to defend himself and feared his son and family coming under real investigation. What he did, if he did it, was worse than what the Clinton Campaign did?

But if what the Clinton Campaign did was "not really that bad," then whatever the Trump Campaign did was also "not really that bad." I will leave aside Manafort and Cohen being sleazeballs whose sleaze came under the microscope. One of the risks of being public. This is the underlying hypocrisy: if the Clinton Campaign did "nothing" then Trump did "nothing." If Trump did "something," then what Comey and the FBI did with help from the Clinton Campaign was also "something." Then comes the lies of Obama officials not pursued.

In the rain.

He remembers every little detail about his conversations with Trump in his book, but said "I don't recall" 245 times in his sworn testimony about the biggest investigation of his career.

It's that whole "under oath" thing.

He can't repeat what's in the book, obviously.

And if he's lying about not being able to recall, no one can prove it and bring perjury charges.

And if he takes the fifth, he is automatically useless to The Party (instead of gradually useless).
